Permissibility of Remarriage After Husband's Death

SUMMARY: The hadith is about a woman who gave birth one day after her husband died and the Prophet Muhammad (PBUH) allowed her to remarry.

It was narrated from Sulaiman bin Yasar that 'Abdullah bin 'Abbas and Abu Salamah bin 'Abdur-Rahman disagreed concerning a woman who gave birth one day after her husband died'.Abdullah bin 'Abbas said: "(She should wait) for the longer of the two periods". Abu Salamah said: "When she has given birth, it becomes permissible for her to remarry". Abu Hurairah came and said: "I agree with my brother's son" -meaning Abu Salamah bin 'Abdur-Rahman. They sent Kuraib, the freed slave of Ibn 'Abbas, to Umm Salamah to ask her about that. He came back to them and told them that she said: "Subai'ah gave birth one day after her husband died;" she mentioned that to the Messenger of Allah and he said: "It has become permissible for you to marry".
أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ، عَنِ ابْنِ الْقَاسِمِ، عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ، وَأَبَا، سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ اخْتَلَفَا فِي الْمَرْأَةِ تُنْفَسُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَقَالَ عَبْدُ اللَّهِ بْنُ عَبَّاسٍ آخِرُ الأَجَلَيْنِ ‏.‏ وَقَالَ أَبُو سَلَمَةَ إِذَا نُفِسَتْ فَقَدْ حَلَّتْ ‏.‏ فَجَاءَ أَبُو هُرَيْرَةَ فَقَالَ أَنَا مَعَ ابْنِ أَخِي ‏.‏ يَعْنِي أَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ ‏.‏ فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ يَسْأَلُهَا عَنْ ذَلِكَ فَجَاءَهُمْ فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ وَلَدَتْ سُبَيْعَةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ فَقَالَ ‏ "‏ قَدْ حَلَلْتِ

EXPLANATIONS:
This hadith discusses the permissibility of remarriage for a widow whose husband has passed away. It was narrated from Sulaiman bin Yasar that 'Abdullah bin 'Abbas and Abu Salamah bin 'Abdur-Rahman disagreed concerning a woman who gave birth one day after her husband died. 'Abdullah bin 'Abbas said that she should wait for the longer of the two periods while Abu Salamah said that when she has given birth it becomes permissible for her to remarry. When they were unable to come to an agreement they sent Kuraib, the freed slave of Ibn 'Abbas, to Umm Salamah to ask her about it. He came back with news that Umm Salama mentioned this case to the Messenger of Allah and he said "It has become permissible for you to marry". This hadith teaches us that even in difficult situations such as this one where there is disagreement between scholars on what is permissible or not; we can always turn towards our beloved prophet's teachings as guidance on how we should act in such cases.
