The Punishment of Wrongful Land Seizure

SUMMARY: This hadith is about a dispute between Arwa bint Uwais and Sa'id b. Zaid over land ownership, which was brought before Marwan b. al-Hakam. Sa'id claims to have heard from the Prophet (PBUH) that whoever wrongfully takes even a span of land will be made to wear seven earths around their neck as punishment. Marwan does not ask for any evidence after this, and Sa'id prays for Allah to make Arwa blind if she has lied and kill her in her own land. Eventually, she loses her eyesight and dies in a pit in her own land.

Hisham b. Urwa reported on the authority of his father (Allah be pleased with him) that Arwa bint Uwais disputed with Sa'id b. Zaid that he had seized some of the land belonging to her. She brought this dispute before Marwan b. al-Hakam. Sa'id said: How could I take a part of her land, after what I heard from Allah's Messenger (may peace be upon'him)? He (Marwan) said: What did you hear from Allah's Messenger ? He said: I heard Allah's Messenger say: He who wrongly took a span of land would be made to wear around his neck seven earths. Marwan said: I do not ask any evidence from you after this. He (Sa'id) said: O Allah, make her blind if she has told a lie and kill her in her own land. He (the narrator) said: She did not die until she had lost her eyesight, and (one day) as she was walking in her land, she fell down into a pit and died.
حَدَّثَنَا أَبُو الرَّبِيعِ الْعَتَكِيُّ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، أَنَّ أَرْوَى بِنْتَ أُوَيْسٍ، ادَّعَتْ عَلَى سَعِيدِ بْنِ زَيْدٍ أَنَّهُ أَخَذَ شَيْئًا مِنْ أَرْضِهَا فَخَاصَمَتْهُ إِلَى مَرْوَانَ بْنِ الْحَكَمِ ‏.‏ فَقَالَ سَعِيدٌ أَنَا كُنْتُ آخُذُ مِنْ أَرْضِهَا شَيْئًا بَعْدَ الَّذِي سَمِعْتُ مِنْ رَسُولِ اللَّهِ قَالَ وَمَا سَمِعْتَ مِنْ رَسُولِ اللَّهِ قَالَ سَمِعْتُ رَسُولَ اللَّهِ يَقُولُ ‏ "‏ مَنْ أَخَذَ شِبْرًا مِنَ الأَرْضِ ظُلْمًا طُوِّقَهُ إِلَى سَبْعِ أَرَضِينَ ‏"‏ ‏.‏ فَقَالَ لَهُ مَرْوَانُ لاَ أَسْأَلُكَ بَيِّنَةً بَعْدَ هَذَا ‏.‏ فَقَالَ اللَّهُمَّ إِنْ كَانَتْ كَاذِبَةً فَعَمِّ بَصَرَهَا وَاقْتُلْهَا فِي أَرْضِهَا ‏.‏ قَالَ فَمَا مَاتَتْ حَتَّى ذَهَبَ بَصَرُهَا ثُمَّ بَيْنَا هِيَ تَمْشِي فِي أَرْضِهَا إِذْ وَقَعَتْ فِي حُفْرَةٍ فَمَاتَتْ

EXPLANATIONS:
This hadith speaks about the consequences of wrongfully seizing someone else's property or land without permission or due process. It is narrated by Hisham bin Urwa on the authority of his father that there was a dispute between Arwa bin Uwais and Sa’id bin Zaid over some land belonging to Arwa which Sa’id had seized without permission or due process. When this dispute was brought before Marwan bin al-Hakam, Sa’id claimed that he heard from Prophet Muhammad ﷺ that whoever wrongfully takes even a span of someone else's property will be made to wear seven earths around their neck as punishment for their crime against another person's rights over their property or possessions. After hearing this statement from Sa’id, Marwan did not ask for any further evidence regarding the case since it was an authentic statement from Prophet Muhammad ﷺ himself regarding such matters related to justice and fairness towards others when it comes to taking possession of something which belongs rightfully belongs to another person without permission or due process being followed firstly by both parties involved in such disputes related to ownership rights over certain properties or possessions . As per this Hadith, Allah Almighty punishes those who take possession unlawfully by making them wear seven earths around their necks as punishment for such wrongful acts committed against other people's rights over certain properties they possess lawfully .
