Obtaining Permission for Marriage

SUMMARY: Marriage should not be arranged without consulting the woman or obtaining her permission.

Narrated Abu Huraira: The Prophet said, "A matron should not be given in marriage except after consulting her; and a virgin should not be given in marriage except after her permission". The people asked, "O Allah's Messenger ! How can we know her permission?" He said, "Her silence (indicates her permission).
حَدَّثَنَا مُعَاذُ بْنُ فَضَالَةَ، حَدَّثَنَا هِشَامٌ، عَنْ يَحْيَى، عَنْ أَبِي سَلَمَةَ، أَنَّ أَبَا هُرَيْرَةَ، حَدَّثَهُمْ أَنَّ النَّبِيَّ قَالَ ‏"‏ لاَ تُنْكَحُ الأَيِّمُ حَتَّى تُسْتَأْمَرَ وَلاَ تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ ‏"‏‏.‏ قَالُوا يَا رَسُولَ اللَّهِ وَكَيْفَ إِذْنُهَا قَالَ ‏"‏ أَنْ تَسْكُتَ

Similarly, he said that a virgin should not be given in marriage except after getting her permission as well. When asked how to know if she has given permission, he said that it can be inferred from her silence. This hadith emphasizes the importance of respecting women’s autonomy and agency when it comes to their own marriages and decisions about their lives.
