Pre-emption Rights in Undivided Joint Property

SUMMARY: The Prophet Muhammad (peace be upon him) gave a ruling regarding the right of pre-emption in undivided joint property, but not when the limits are defined or ways and streets are fixed.

Narrated Jabir bin 'Abdullah: Allah's Messenger gave a verdict regarding Shuf'a in every undivided joint thing (property). But if the limits are defined (or demarcated) or the ways and streets are fixed, then there is no pre-emption.
حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا عَبْدُ الْوَاحِدِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ـ رضى الله عنهما ـ قَالَ قَضَى رَسُولُ اللَّهِ بِالشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ، فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلاَ شُفْعَةَ‏.‏

EXPLANATIONS:
This hadith discusses the right of pre-emption in undivided joint property. According to this hadith, if two people own an undivided piece of property together, then one person has the right to buy out the other person's share before anyone else can purchase it. However, if there are limits defined or ways and streets fixed on that piece of property then there is no such right of pre-emption. This teaches us that we should be fair when dealing with our partners in business or any other kind of partnership. We should also respect each other's rights even if we have different opinions about how to divide up a shared asset.
