Justice for Miscarriage in Islam

SUMMARY: The Prophet Muhammad (PBUH) gave a judgement that a slave or slave-girl of fair complexion and excellence should be given to a woman from the Hudhayl tribe who had suffered a miscarriage due to another woman throwing a stone at her.

Yahya related to me from Malik from Ibn Shihab from Abu Salama ibn Abd ar-Rahman ibn Awf from Abu Hurayra that a woman from the Hudhayl tribe threw a stone at a woman from the same tribe, and she had a miscarriage. The Messenger of Allah, may Allah bless him and grant him peace, gave a judgement that a slave or slave-girl of fair complexion and excellence should be given to her.
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ امْرَأَتَيْنِ، مِنْ هُذَيْلٍ رَمَتْ إِحْدَاهُمَا الأُخْرَى فَطَرَحَتْ جَنِينَهَا فَقَضَى فِيهِ رَسُولُ اللَّهِ بِغُرَّةٍ عَبْدٍ أَوْ وَلِيدَةٍ

EXPLANATIONS:
This hadith is about justice and fairness in Islam. It tells us that if someone causes harm to another person, they must pay for it in some way. In this case, the Prophet Muhammad ordered that the person who caused harm must give something of value - either a slave or slave girl - as compensation for what happened. This shows us how important justice is in Islam and how we should always strive to do what is right and fair when dealing with others. We can also learn from this hadith that even though slavery was allowed during the time of the Prophet Muhammad, he still wanted people to be treated fairly and with respect regardless of their social status or background.
