Compensation for Fetal Loss

SUMMARY: The Prophet Muhammad disapproved of a man's rhyming speech when he was asked to pay damages for a fetus killed in its mother's womb.

Yahya related to me from Malik from Ibn Shihab from Said ibn al- Musayyab that the Messenger of Allah, may Allah bless him and grant him peace, gave a judgement that the compensation for a fetus killed in its mother's womb was a slave or slave-girl of fair complexion and excellence. The one against whom the judgement was given said, "Why should I pay damages for that which did not drink or eat or speak or make any cry. The like of that is nothing". The Messenger of Allah, may Allah bless him and grant him peace, said, "This is only one of the brothers of the diviners". He disapproved of the rhyming speech of the man's declaration.
وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّ رَسُولَ اللَّهِ قَضَى فِي الْجَنِينَ يُقْتَلُ فِي بَطْنِ أُمِّهِ بِغُرَّةٍ عَبْدٍ أَوْ وَلِيدَةٍ فَقَالَ الَّذِي قُضِيَ عَلَيْهِ كَيْفَ أَغْرَمُ مَا لاَ شَرِبَ وَلاَ أَكَلْ وَلاَ نَطَقَ وَلاَ اسْتَهَلّ وَمِثْلُ ذَلِكَ بَطَلْ ‏.‏ فَقَالَ رَسُولُ اللَّهِ ‏ "‏ إِنَّمَا هَذَا مِنْ إِخْوَانِ الْكُهَّانِ

In this hadith, the Prophet Muhammad is teaching us about the importance of compensation for fetal loss. He explains that if a fetus is killed in its mother’s womb, then the person responsible should pay damages in the form of a slave or slave girl with fair complexion and excellence. When one person objected to this ruling by saying that it was not necessary to pay damages since the fetus did not eat or drink or speak or make any cry, the Prophet disapproved of his rhyming speech and said that it was similar to divination. This hadith teaches us about justice and fairness even when dealing with something as small as an unborn child. It also teaches us about respecting others’ opinions and avoiding speaking in rhymes which can be seen as disrespectful.
