Musnad Ahmad 770 (Book 5, Hadith 202) #34428
Dispute Over Daughter of Hamzah Settled By Prophet Muhammad (PBUH)

SUMMARY: The hadith is about the dispute between Ali, Ja'far and Zaid over the daughter of Hamzah. The Prophet Muhammad (PBUH) settled the dispute by saying that she should be with her maternal aunt as she is like a mother to her.

It was narrated that 'Ali (رضي الله عنه) said: When we left Makkah, the daughter of Hamzah followed us, crying: O uncle, O uncle. I took her by the hand and gave her to Fatimah and said: Here is your cousin. When we came to Madinah, Ja'far, Zaid bin Harithah and I disputed concerning her, Ja'far said: She is the daughter of my paternal uncle and her maternal aunt is married to me - meaning Asma’ bint 'Umais, Zaid said. She is the daughter of my brother. I said: I took her and she is the daughter of my paternal uncle. The Messenger of Allah said: "As for you, O Ja'far, you resemble me in appearance and attitude. As for you, O Ali, you are of me and I am of you. As for you, O Zaid, you are our brother and our freed slave. The girl should be with her maternal aunt, for the maternal aunt is like a mother". I said: O Messenger of Allah , why don't you marry her? He said: 'She is the daughter of my brother through breastfeeding".

QUICK LESSONS:
Respect family ties, resolve disputes peacefully without resorting violence or arguments etc..

EXPLANATIONS:
This hadith narrates an incident where Ali, Ja'far and Zaid were in a dispute over the daughter of Hamzah who followed them when they left Makkah. Ali took her by hand and gave her to Fatimah while Ja'far claimed that she was his paternal uncle's daughter and his maternal aunt was married to him while Zaid said that she was his brother's daughter. The Prophet Muhammad then settled this dispute by saying that since the maternal aunt is like a mother, she should stay with her maternal aunt instead. He also suggested not marrying her as she was related through breastfeeding which shows us how important it is for us to respect family ties even if they are through breastfeeding or adoption. This hadith also teaches us how important it is for us to settle disputes peacefully without resorting to violence or arguments as we can see from how calmly and wisely the Prophet handled this situation despite being in such a difficult situation himself at the time due to migration from Makkah to Madinah.
