Attributing Children to their Mothers

SUMMARY: The Prophet (PBUH) separated a couple who had invoked curses on each other and attributed the child to the woman.

Ibn 'Umar said A man invoked curses on his wife (charging her of adultery) during the time of Apostle of Allaah and disowned the child. The Apostle of Allaah therefore separated them and attributed the child to the woman. Abu Dawud said "The words narrated by Malik alone are "and he attributed the child to the woman"." Abu Dawud said: The words narrated by Malik alone are: "and he attributed the child to the woman". Yunus narrated from Al Zuhri on the authority of Sahl bin Sa’d in the tradition regarding li’an(invoking curses). He disowned her conception hence her child was attributed to her.
حَدَّثَنَا الْقَعْنَبِيُّ، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ رَجُلاً، لاَعَنَ امْرَأَتَهُ فِي زَمَانِ رَسُولِ اللَّهِ وَانْتَفَى مِنْ وَلَدِهَا فَفَرَّقَ رَسُولُ اللَّهِ بَيْنَهُمَا وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ ‏.‏ قَالَ أَبُو دَاوُدَ الَّذِي تَفَرَّدَ بِهِ مَالِكٌ قَوْلُهُ ‏ "‏ وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ ‏"‏ ‏.‏ وَقَالَ يُونُسُ عَنِ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ فِي حَدِيثِ اللِّعَانِ وَأَنْكَرَ حَمْلَهَا فَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا

EXPLANATIONS:
This hadith is about a man and woman who invoked curses on each other during the time of Prophet Muhammad (PBUH). As a result of this, they were separated by the Prophet. He also attributed the child to its mother despite her husband disowning it. This shows us that even in difficult situations such as this one, justice should be upheld. It teaches us that children should always be attributed to their mothers regardless of any disputes between parents. Furthermore, it teaches us that invoking curses is not an acceptable way to solve problems or disputes between couples or family members.
