Sunan an-Nasai 4941 (Book 46, Hadith 71) #19473
Punishment for Theft

SUMMARY: The punishment for theft should not be more severe than the value of the stolen item.

It was narrated that 'Aishah said: "The hand of the thief should not be cut off for anything less than a Hajafa or a Turs (two kinds of shields)," each of which was worth a (decent) price.

QUICK LESSONS:
Be fair and just when punishing people; Make sure punishments fit with the crime committed; Value things appropriately so we can understand how much something is really worth in order to determine an appropriate punishment for it; Follow Islamic teachings on punishments for crimes such as theft; Respect other people's property rights; Do not take anything without permission from its rightful owner.

EXPLANATIONS:
This hadith is about the punishment for theft. It was narrated by 'Aishah that the hand of a thief should not be cut off if they steal something worth less than a Hajafa or Turs, which are two kinds of shields and each one is worth a decent price. This means that if someone steals something that is worth less than these two items, then their hand should not be cut off as punishment. Instead, they should receive an appropriate punishment according to what they have stolen. This hadith teaches us to be fair and just when punishing people and to make sure that punishments fit with the crime committed. It also teaches us to value things appropriately so we can understand how much something is really worth in order to determine an appropriate punishment for it.
