The Rightful Ownership of Lifelong Gifts

SUMMARY: A person who has been given a lifelong gift is entitled to keep it and pass it on to their descendants, and the giver cannot impose any conditions or exceptions.

Ibn Abi Dhi'b narrated from Ibn Shihab, from Abu Salamah, from Jabir, that the Messenger of Allah ruled -concerning a person who has been given a lifelong gift ('Umra)- that it belongs to him and to his descendants: "It is undoubtedly his, and it is not permissible for the giver to stipulate any conditions or exceptions". Abu Salamah said: "Because he gave it as a gift and thus, it is subject to the same ruling as the estate, and the condition (that it will revert to the giver on the death of recipient) has become invalid".
أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ، عَنِ ابْنِ أَبِي فُدَيْكٍ، قَالَ حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ، عَنْ جَابِرٍ، أَنَّ رَسُولَ اللَّهِ قَضَى فِيمَنْ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَهِيَ لَهُ بَتْلَةٌ لاَ يَجُوزُ لِلْمُعْطِي مِنْهَا شَرْطٌ وَلاَ ثُنْيَا ‏.‏ قَالَ أَبُو سَلَمَةَ لأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ فَقَطَعَتِ الْمَوَارِيثُ شَرْطَهُ

EXPLANATIONS:
This hadith explains that when someone is given a lifelong gift ('Umra'), they are entitled to keep it and pass it on to their descendants. The giver of the gift cannot impose any conditions or exceptions upon the recipient; once the gift has been given as such, its status becomes similar to an estate and any stipulations become invalid. This hadith teaches us that gifts should be given with no strings attached; if we give something away as a present then we should not expect anything in return or try to control how our gifts are used by others. It also shows us that generosity can have long-lasting effects; even after we are gone our gifts can continue benefiting people for generations afterwards.
