Rights of Reviving Dead Land

SUMMARY: Reviving dead land is a right of the person who does it, and taking or planting without right is not allowed.

Yahya related from Malik from Hisham ibn Urwa from his father that the Messenger of Allah, may Allah bless him and grant him peace, said, "If anyone revives dead land, it belongs to him, and the unjust root has no right". Malik explained, "The unjust root is whatever is taken, or planted without right".
حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ أَحْيَا أَرْضًا مَيِّتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ

EXPLANATIONS:
This hadith explains that reviving dead land is a right of the person who does it, and taking or planting without right is not allowed. The Messenger of Allah, may Allah bless him and grant him peace, said that if anyone revives dead land then it belongs to them. Malik explained further that an unjust root refers to anything taken or planted without the rightful permission. This hadith teaches us about respecting other people's rights and property as well as being mindful when we are using resources from our environment. It also encourages us to be productive in our environment by reviving dead land for our own benefit while still respecting others' rights over their property.
