Giving Estate to Victims' Relatives

SUMMARY: The hadith is about Umar giving the camels of the one who was killed to his brother, as he heard from the Prophet that the killer should not get anything from the estate of the one he murdered.

It was narrated that 'Amr bin Shu'aib said: 'Umar (رضي الله عنه) said. Were it not that I heard the Messenger of Allah say, "The killer gets nothing (from the estate of the one he murdered),' I would have included you among the heirs. And he called the maternal uncle of the one who had been killed and gave the camels to him. It was narrated from Mujahid bin Jabr. and he mentioned the same Hadeeth. He said: 'Umar IV took thirty three year-old she-camels, thirty four year-old she-camels and forty she camels between the ages of five and eight years, all of which were pregnant, then he called the brother of the one who had been killed and gave them to him, not to his father. And he said: I heard the Messenger of Allah say: "The killer gets nothing'.
حَدَّثَنَا هُشَيْمٌ، وَيَزِيدُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، قَالَ قَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ لَوْلَا أَنِّي سَمِعْتُ رَسُولَ اللَّهِ يَقُولُ لَيْسَ لِقَاتِلٍ شَيْءٌ لَوَرَّثْتُكَ قَالَ وَدَعَا خَالَ الْمَقْتُولِ فَأَعْطَاهُ الْإِبِلَ حَدَّثَنَا يَعْقُوبُ حَدَّثَنَا أَبِي عَنِ ابْنِ إِسْحَاقَ حَدَّثَنِي عَبْدُ اللَّهِ بْنُ أَبِي نَجِيحٍ وَعَمْرُو بْنُ شُعَيْبٍ كِلَاهُمَا عَنْ مُجَاهِدِ بْنِ جَبْرٍ فَذَكَرَ الْحَدِيثَ وَقَالَ أَخَذَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ مِنْ الْإِبِلِ ثَلَاثِينَ حِقَّةً وَثَلَاثِينَ جَذَعَةً وَأَرْبَعِينَ ثَنِيَّةً إِلَى بَازِلِ عَامِهَا كُلُّهَا خَلِفَةٌ قَالَ ثُمَّ دَعَا أَخَا الْمَقْتُولِ فَأَعْطَاهَا إِيَّاهُ دُونَ أَبِيهِ وَقَالَ سَمِعْتُ رَسُولَ اللَّهِ يَقُولُ لَيْسَ لِقَاتِلٍ شَيْءٌ‏.‏

EXPLANATIONS:
This hadith is about Umar's decision to give away camels belonging to a person who was killed, to his brother instead of giving it to his father or any other relative. This decision was based on a saying by Prophet Muhammad that "the killer gets nothing from the estate of one he murdered". This hadith teaches us an important lesson in justice and fairness; that even if someone has committed a crime, their family should not be punished for it. It also teaches us about mercy and compassion; that we should show mercy towards those who have been wronged, even if they are related to someone who has done wrong.
