Payment of Ghurrah Slave for Miscarriage

SUMMARY: The Prophet Muhammad (S.A.W) ruled that the payment of a ghurrah male or female slave should be given in the case of a woman's miscarriage from Banu Libyan, and if she dies, her inheritance should be given to her children and husband, and her blood-money should be paid by her 'Asabah.

Abu Hurairah narrated that : the Messenger of Allah(S.A.W) judged the payment of a ghurrah male or female slave in the case of a woman's fetus from Banu Libyan which miscarried. Then the woman who was required to give the ghurrah died, so the Messenger of Allah(S.A.W) judged that her inheritance be given to her children and her husband, and that her blood-money be paid by her 'Asabah.
حَدَّثَنَا قُتَيْبَةُ، قال حَدَّثَنَا اللَّيْثُ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ قَضَى فِي جَنِينِ امْرَأَةٍ مِنْ بَنِي لَحْيَانَ سَقَطَ مَيِّتًا بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ ثُمَّ إِنَّ الْمَرْأَةَ الَّتِي قُضِيَ عَلَيْهَا بِالْغُرَّةِ تُوُفِّيَتْ فَقَضَى رَسُولُ اللَّهِ أَنَّ مِيرَاثَهَا لِبَنِيهَا وَزَوْجِهَا وَأَنَّ عَقْلَهَا عَلَى عَصَبَتِهَا ‏.‏ قَالَ أَبُو عِيسَى وَرَوَى يُونُسُ هَذَا الْحَدِيثَ عَنِ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ نَحْوَهُ وَرَوَاهُ مَالِكٌ عَنِ الزُّهْرِيِّ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ وَمَالِكٌ عَنِ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ عَنِ النَّبِيِّ مُرْسَلٌ

This hadith is about the ruling of Prophet Muhammad(S.A.W) regarding payment for a ghurrah male or female slave in the case of a woman's miscarriage from Banu Libyan tribe. If this woman dies, then her inheritance will go to her children and husband while her blood money will be paid by her 'Asabahs'. This hadith teaches us that justice must prevail even after death as it is important to take care of one's family even after their passing away. It also teaches us that we must always strive for justice no matter what situation we are in as it is an important part of our faith as Muslims. We must also remember that Allah has commanded us to take care of our families so we must always strive to do so even if it means going beyond our means at times.
