Inheritance According to Sunnah

SUMMARY: This hadith is about two grandmothers who asked Abu Bakr and Umar bin Al-Khattab about their inheritance. Abu Bakr and Umar both ruled that the grandmothers should receive a sixth of their inheritance according to the Sunnah of Prophet Muhammad (S.A.W).

Qabisah bin Dhuw'aib said: "A grandmother came to Abu Bakr to ask him about her inheritance. He said to her, 'There is noting for you in the Book of Allah and there is nothing for you in the Sunnah of the Messenger of Allah(S.A.W). So ,return until I ask the people. So he asked the people and Al-Mughirah bin Shu'bah said: 'I was present when the Messenger of Allah(S.A.W) gave her (case) a sixth'. So he said: 'Was anyone else with you?' Muhammad bin Maslamah stood to say the same as what Al-Mughirah bin Shu'bah said. So Abu Bakr implemented that for her". Then the other grandmother came to 'Umar bin Al-Khattab to ask him about her inheritance. He said: 'There is nothing in the Book of Allah for you, but there is that sixth. So if the two of you are together then it is for both of you, and whichever of you remains), then it is for her'."
حَدَّثَنَا الأَنْصَارِيُّ، حَدَّثَنَا مَعْنٌ، قال حَدَّثَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُثْمَانَ بْنِ إِسْحَاقَ بْنِ خَرَشَةَ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ، قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ تَسْأَلُهُ مِيرَاثَهَا ‏.‏ قَالَ فَقَالَ لَهَا مَا لَكِ فِي كِتَابِ اللَّهِ شَيْءٌ وَمَا لَكِ فِي سُنَّةِ رَسُولِ اللَّهِ شَيْءٌ فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ ‏.‏ فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ حَضَرْتُ رَسُولَ اللَّهِ فَأَعْطَاهَا السُّدُسَ ‏.‏ فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ ‏.‏ قَالَ ثُمَّ جَاءَتِ الْجَدَّةُ الأُخْرَى إِلَى عُمَرَ بْنِ الْخَطَّابِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللَّهِ شَيْءٌ وَلَكِنْ هُوَ ذَاكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا ‏.‏ قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنْ بُرَيْدَةَ ‏.‏ وَهَذَا أَحْسَنُ وَهُوَ أَصَحُّ مِنْ حَدِيثِ ابْنِ عُيَيْنَةَ

EXPLANATIONS:
This hadith is about two grandmothers who asked Abu Bakr and Umar bin Al-Khattab about their inheritance rights according to Islamic law. Qabisah bin Dhuw'aib reported that when the first grandmother came to ask Abu Bakr for her inheritance, he said there was nothing for her in the Book of Allah or in the Sunnah of Prophet Muhammad (S.A.W). He then asked if anyone else was present when Prophet Muhammad gave her a sixth share and both Al-Mughirah bin Shu'bah and Muhammad Bin Maslamah confirmed this ruling so it was implemented for her. When the second grandmother came to 'Umar asking him for her share he said there was nothing in the Book of Allah but she should receive a sixth share as well if they were together or whichever one remained alive would get it alone. This hadith teaches us that we must follow Islamic law regarding inheritance as taught by Prophet Muhammad (S.A.W). It also teaches us that we must be fair with our family members when it comes to distributing wealth after someone passes away according to Islamic teachings so everyone gets what they are entitled too without any discrimination or favoritism towards certain individuals over others based on personal relationships or feelings towards them instead of following what is right according to Islam's teachings on this matter which are clear cut and easy enough for everyone understand without any confusion or doubt regarding how much each person should get from an estate after someone passes away from this world into eternity with Allah Almighty .
