Bloodwite for Intentional and Unintentional Murder

SUMMARY: The hadith discusses the bloodwite for intentional and unintentional murder.

Narrated 'Uthman b. 'Affan and Zaid b. Thabit: The bloodwite for what resembled intentional murder should be forty pregnant she-camels in their fifth year, thirty she-camels in their fourth year, and thirty she-camels in their third year. The bloodwite for unintentional murder is thirty she-camels in their fourth year, thirty she-camels in their third year, and twenty she-camels in their second year.
حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا أَبُو الأَحْوَصِ، عَنْ سُفْيَانَ، عَنْ أَبِي إِسْحَاقَ، عَنْ عَاصِمِ بْنِ ضَمْرَةَ، قَالَ قَالَ عَلِيٌّ رضى الله عنه فِي الْخَطَإِ أَرْبَاعًا خَمْسٌ وَعِشْرُونَ حِقَّةً وَخَمْسٌ وَعِشْرُونَ جَذَعَةً وَخَمْسٌ وَعِشْرُونَ بَنَاتِ لَبُونٍ وَخَمْسٌ وَعِشْرُونَ بَنَاتِ مَخَاضٍ

EXPLANATIONS:
This hadith discusses the bloodwite that should be paid in cases of intentional or unintentional murder. In cases of intentional murder, forty pregnant she-camels in their fifth year, thirty she-camels in their fourth year, and thirty she-camels in their third year must be paid as diyya or qasama. For unintentional murder, thirty she-camels in their fourth year, thirty she-camels in their third year, and twenty she-camels in their second year must be paid as diyya or qasama. This hadith teaches us that justice should always prevail when it comes to punishing those who commit crimes such as murder; however it also teaches us that mercy should also be taken into consideration when deciding on a punishment for those who have committed an unintentional crime such as accidental manslaughter.
