Punishment for Adultery

SUMMARY: A man committed adultery and was punished for it, but when it was discovered that he was married, the punishment changed to stoning.

Jabir said: A man committed fornication with a woman. It was not known that he was married. So he was flogged. It was then known that he was married, so he was stoned to death.
حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الرَّحِيمِ أَبُو يَحْيَى الْبَزَّازُ، أَخْبَرَنَا أَبُو عَاصِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، أَنَّ رَجُلاً، زَنَى بِامْرَأَةٍ فَلَمْ يَعْلَمْ بِإِحْصَانِهِ فَجُلِدَ ثُمَّ عَلِمَ بِإِحْصَانِهِ فَرُجِمَ

This hadith is about a man who committed adultery with a woman. At first, he was flogged as punishment for his crime. However, when it became known that he was married at the time of his offense, the punishment changed to stoning. This hadith teaches us that adultery is a serious offense and should be punished accordingly. It also shows us that if someone commits an act of adultery while being married, they will face harsher consequences than if they were unmarried at the time of their offense. Furthermore, this hadith serves as an example of how justice should be served in cases such as these; even though the man initially received one form of punishment for his crime, once more information came to light about his marital status at the time of his offense, justice demanded that he receive another form of punishment instead.
