Pre-emption Rights in Joint Property

SUMMARY: The right of pre-emption is applicable in joint property, but not when the land is divided and the way is demarcated.

Narrated Jabir bin 'Abdullah: The Prophet said, "The right of pre-emption is valid in every joint property, but when the land is divided and the way is demarcated, then there is no right of pre-emption".
حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا عَبْدُ الْوَاحِدِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ـ رضى الله عنهما ـ قَالَ قَضَى النَّبِيُّ بِالشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ، فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلاَ شُفْعَةَ‏.‏

EXPLANATIONS:
This hadith explains that when two or more people own a piece of land together, they have the right to pre-empt each other if one of them wishes to sell it. However, this right does not apply if the land has been divided and its boundaries have been established. This means that once a person has their portion of the land clearly marked out, they can no longer exercise their right to pre-empt another person's portion. This hadith teaches us that we should be mindful of our rights and responsibilities when it comes to owning property with others. We should also be aware that once we divide up our property among ourselves, we cannot go back on our decisions or take away someone else's rights without their consent.
