The Maternal Aunt is Like Mother

SUMMARY: The hadith is about the Prophet (PBUH) deciding in favor of Ja'far regarding the custody of a girl, and explaining that the maternal aunt is like a mother.

Narrated Ali ibn AbuTalib: Zayd ibn Harithah went out to Mecca and brought the daughter of Hamzah with him. Then Ja'far said: I shall take her; I have more right to her; she is my uncle's daughter and her maternal aunt is my wife; the maternal aunt is like mother. Ali said: I am more entitled to take her. She is my uncle's daughter. The daughter of the Messenger of Allah is my wife, and she has more right to her. Zayd said: I have more right to her. I went out and journeyed to her, and brought her with me. The Prophet came out. The narrator mentioned the rest of the tradition. He (ie the Prophet) said: As for the girl, I decided in favour of Ja'far. She will live with her maternal aunt. The maternal aunt is like mother.
حَدَّثَنَا الْعَبَّاسُ بْنُ عَبْدِ الْعَظِيمِ، حَدَّثَنَا عَبْدُ الْمَلِكِ بْنُ عَمْرٍو، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ يَزِيدَ بْنِ الْهَادِ، عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ، عَنْ نَافِعِ بْنِ عُجَيْرٍ، عَنْ أَبِيهِ، عَنْ عَلِيٍّ، - رضى الله عنه - قَالَ خَرَجَ زَيْدُ بْنُ حَارِثَةَ إِلَى مَكَّةَ فَقَدِمَ بِابْنَةِ حَمْزَةَ فَقَالَ جَعْفَرٌ أَنَا آخُذُهَا أَنَا أَحَقُّ بِهَا ابْنَةُ عَمِّي وَعِنْدِي خَالَتُهَا وَإِنَّمَا الْخَالَةُ أُمٌّ ‏.‏ فَقَالَ عَلِيٌّ أَنَا أَحَقُّ بِهَا ابْنَةُ عَمِّي وَعِنْدِي ابْنَةُ رَسُولِ اللَّهِ وَهِيَ أَحَقُّ بِهَا ‏.‏ فَقَالَ زَيْدٌ أَنَا أَحَقُّ بِهَا أَنَا خَرَجْتُ إِلَيْهَا وَسَافَرْتُ وَقَدِمْتُ بِهَا ‏.‏ فَخَرَجَ النَّبِيُّ فَذَكَرَ حَدِيثًا قَالَ ‏ "‏ وَأَمَّا الْجَارِيَةُ فَأَقْضِي بِهَا لِجَعْفَرٍ تَكُونُ مَعَ خَالَتِهَا وَإِنَّمَا الْخَالَةُ أُمٌّ

EXPLANATIONS:
This hadith narrates an incident where Zayd ibn Harithah brought a girl from Mecca and both Ali and Ja'far wanted to take her in their custody. Both of them argued that they have more right to her as she was related to them through family ties. In this situation, the Prophet Muhammad (PBUH) decided in favor of Ja'far as he was related to her through his wife who was her maternal aunt. He explained that the maternal aunt has more right over her than anyone else because she is like a mother figure for her. This hadith teaches us that we should respect our relatives and give priority to those who are closer to us by blood or marriage ties when it comes to taking care of someone or making decisions about them. It also teaches us how important it is for children to be taken care by their close relatives such as their mothers or maternal aunts instead of strangers so they can grow up with love and affection from people who are familiar with them.
