Punishment for Slave-Girls Who Commit Illegal Sexual Intercourse

SUMMARY: The hadith is about the punishment for a slave-girl who commits illegal sexual intercourse and how her owner should not blame her after the legal punishment.

Narrated Abu Huraira: The Prophet said, "If a slave-girl commits illegal sexual intercourse and it is proved beyond doubt, then her owner should lash her and should not blame her after the legal punishment. And then if she repeats the illegal sexual intercourse he should lash her again and should not blame her after the legal punishment, and if she commits it a third time, then he should sell her even for a hair rope".
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، حَدَّثَنَا اللَّيْثُ، قَالَ حَدَّثَنِي سَعِيدٌ الْمَقْبُرِيُّ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ ـ رضى الله عنه ـ أَنَّهُ سَمِعَهُ يَقُولُ قَالَ النَّبِيُّ ‏ "‏ إِذَا زَنَتِ الأَمَةُ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا، وَلاَ يُثَرِّبْ، ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا، وَلاَ يُثَرِّبْ، ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَلْيَبِعْهَا، وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ

This hadith discusses the punishment for a slave girl who commits illegal sexual intercourse. According to this hadith, if it is proven beyond doubt that she has committed such an act, then her owner should lash her as a form of legal punishment. However, he should not blame or criticize her after this legal punishment has been carried out. If she repeats the act again, then she should be lashed again and not blamed afterwards. If she continues to commit it a third time, then according to this hadith, her owner must sell her even if it is only for something as small as a hair rope. This teaches us that we must be just in our punishments and that we must not take any extra measures against someone once they have received their due justice from us. It also teaches us that we must be patient with people when they make mistakes and give them chances to improve themselves instead of punishing them too harshly or too quickly without giving them an opportunity to change their ways first.
