Punishment for Stealing Produce and Spadix of Palm Trees

SUMMARY: Stealing produce or the spadix of palm trees should not be punished by cutting off the hand.

Rafi bin Khadij said: "I heard the Messenger of Allah say: 'The hand is not be cut off for (stealing) produce or the spadix of palm trees"'.
أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا اللَّيْثُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، عَنْ عَمِّهِ، أَنَّ رَافِعَ بْنَ خَدِيجٍ، قَالَ سَمِعْتُ رَسُولَ اللَّهِ يَقُولُ ‏ "‏ لاَ قَطْعَ فِي ثَمَرٍ وَلاَ كَثَرٍ ‏"‏ ‏.‏ وَالْكَثَرُ الْجُمَّارُ

This hadith is about a punishment for stealing produce or the spadix of palm trees. The Prophet Muhammad said that hands should not be cut off as a punishment for this type of theft.
