Sunan an-Nasai 3487 (Book 27, Hadith 99) #18099
Ownership of Children Born to Slave Women

SUMMARY: The Prophet Muhammad (PBUH) ruled that a child born to a slave woman belongs to the owner of the bed, not to the one who claims paternity.

It was narrated that 'Aishah said: "Sa'd bin Abi Waqqas and 'Abd bin Zam'ah disputed concerning a son of Zam'ah. Sa'd said: 'My brother 'Utbah urged me, if I came to Makkah: Look for the son of the slave woman of Zam'ah, for he is my son'. 'Abd bin Zam'ah said: 'He is the son of my father's slave woman who was born on my father's bed'. The Messenger of Allah saw that he resembled 'Utbah, but he said: 'The child is the bed's. Veil yourself from him, O Sawdah'."

QUICK LESSONS:
Accept what is fair according Islamic law and practice self restraint when it comes to matters such as these.

EXPLANATIONS:
This hadith is about a dispute between Sa'd bin Abi Waqqas and 'Abd bin Zam'ah concerning the ownership of a son of Zam'ah. Sa'd claimed that he was his son while 'Abd bin Zam'ah said he was his father's slave woman's son born on his father's bed. The Prophet Muhammad saw that he resembled 'Utbah but ruled that since he was born on his father's bed, he belonged to him and not Sa'd. This hadith teaches us an important lesson about ownership; children born to slave women belong to their owners and not necessarily those who claim paternity. It also teaches us about justice; even though it may be difficult for someone in this situation, we must accept what is fair according to Islamic law and practice self restraint when it comes to matters such as these.
