Resolving Disputes with Justice

SUMMARY: The Prophet (PBUH) settled a dispute between two men over the ownership of a boy by determining that the boy belonged to the man whose bed he was born on.

Narrated 'Aisha: Sa'd bin Abi Waqqas and 'Abu bin Zam'a had a dispute over a boy. Sa'd said, "O Allah's Messenger ! This (boy) is the son of my brother, 'Utba bin Abi Waqqas who told me to be his custodian as he was his son. Please notice to whom he bears affinity". And 'Abu bin Zam'a said, "This is my brother, O Allah's Messenger ! He was born on my father's bed by his slave girl". Then the Prophet looked at the boy and noticed evident resemblance between him and 'Utba, so he said, "He (the toy) is for you, O 'Abu bin Zam'a, for the boy is for the owner of the bed, and the stone is for the adulterer. Screen yourself before the boy, O Sauda bint Zam'a"'.Aisha added: Since then he had never seen Sauda.
حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، حَدَّثَنَا اللَّيْثُ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ ـ رضى الله عنها ـ أَنَّهَا قَالَتِ اخْتَصَمَ سَعْدُ بْنُ أَبِي وَقَّاصٍ وَعَبْدُ بْنُ زَمْعَةَ فِي غُلاَمٍ فَقَالَ سَعْدٌ هَذَا يَا رَسُولَ اللَّهِ ابْنُ أَخِي عُتْبَةَ بْنِ أَبِي وَقَّاصٍ عَهِدَ إِلَىَّ أَنَّهُ ابْنُهُ، انْظُرْ إِلَى شَبَهِهِ‏.‏ وَقَالَ عَبْدُ بْنُ زَمْعَةَ هَذَا أَخِي يَا رَسُولَ اللَّهِ، وُلِدَ عَلَى فِرَاشِ أَبِي مِنْ وَلِيدَتِهِ‏.‏ فَنَظَرَ رَسُولُ اللَّهِ إِلَى شَبَهِهِ فَرَأَى شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ ‏ "‏ هُوَ لَكَ يَا عَبْدُ، الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ، وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ بِنْتَ زَمْعَةَ ‏"‏‏.‏ قَالَتْ فَلَمْ يَرَ سَوْدَةَ قَطُّ‏.‏

EXPLANATIONS:
This hadith is about how Prophet Muhammad (PBUH) resolved a dispute between two men over the ownership of a boy. Sa'd bin Abi Waqqas and 'Abu bin Zam'a were arguing over who should have custody of this child. Sa'd claimed that he was his brother's son and Abu claimed that he was his brother's son from his father's slave girl. To settle this dispute, Prophet Muhammad (PBUH) looked at the child and noticed that he resembled Utba more than Abu did. He then declared that since it is clear who fathered him, then he belongs to Abu bin Zam'a as per Islamic law which states that children belong to their fathers regardless of their mother's status in society. Furthermore, Prophet Muhammad also advised Sauda bint Zam'a to be careful around her son so as not to cause any harm or distress for him due to her past actions which led up to his birth. This hadith teaches us about justice and fairness in resolving disputes while also emphasizing on protecting children from any harm or distress caused by adults’ actions or decisions regarding them.
