Ransom for Misled Children

SUMMARY: A judgement was given about a slave woman who misled a man into believing she was free. It was decided that the man should ransom his children with their like of slaves.

Malik related to me that he had heard that Umar ibn al-Khattab or Uthman ibn Affan gave a judgement about a slave woman who misled a man about herself and said that she was free. He married her and she bore children. It was decided that he should ransom his children with their like of slaves. Yahya said that he heard Malik say, "To ransom them with their price is more equitable in this case, Allah willing".
وَحَدَّثَنِي مَالِكٌ، أَنَّهُ بَلَغَهُ أَنَّ عُمَرَ بْنَ الْخَطَّابِ، أَوْ عُثْمَانَ بْنَ عَفَّانَ قَضَى أَحَدُهُمَا فِي امْرَأَةٍ غَرَّتْ رَجُلاً بِنَفْسِهَا وَذَكَرَتْ أَنَّهَا حُرَّةٌ فَتَزَوَّجَهَا فَوَلَدَتْ لَهُ أَوْلاَدًا فَقَضَى أَنْ يَفْدِيَ وَلَدَهُ بِمِثْلِهِمْ ‏.‏ قَالَ يَحْيَى سَمِعْتُ مَالِكًا يَقُولُ وَالْقِيمَةُ أَعْدَلُ فِي هَذَا إِنْ شَاءَ اللَّهُ

EXPLANATIONS:
This hadith is about a judgement given regarding a slave woman who misled a man into believing she was free and married him. The judgement decided that the man should ransom his children with their like of slaves. This means that if the children were male then they would be ransomed with male slaves and if they were female then they would be ransomed with female slaves. This hadith teaches us to be honest in our dealings and not to mislead people as it can have serious consequences for both parties involved. We must also remember to abide by judgements made by those in authority as this is part of being an obedient Muslim.
