(Book 28, Hadith 17) #36177
Marriage and Divorce in Islam

SUMMARY: The hadith is about a man who divorced his wife three times and then wanted to marry her again, but the Prophet Muhammad forbade him from doing so until she had consummated another marriage.

Yahya related to me from Malik from al-Miswar ibn Rifaa al- Quradhi from az-Zubayr ibn Abd ar-Rahman ibn az-Zubayr that Rifaa ibn Simwal divorced his wife, Tamima bint Wahb, in the time of the Messenger of Allah, may Allah bless him and grant him peace, three times. Then she married Abd ar-Rahman ibn az-Zubayr and he turned from her and could not consummate the marriage and so he parted from her. Rifaa wanted to marry her again and it was mentioned to the Messenger of Allah, may Allah bless him and grant him peace, and he forbade him to marry her. He said, "She is not halal for you until she has tasted the sweetness of intercourse".

EXPLANATIONS:
This hadith discusses the Islamic laws regarding marriage and divorce. According to this hadith, if a man divorces his wife three times, he is not allowed to remarry her until she has consummated another marriage. This law was put in place by the Prophet Muhammad as a way of protecting women's rights in marriage. It ensures that women are not taken advantage of or mistreated by their husbands, as they have the right to seek out other partners if their current one does not treat them well. Additionally, it also serves as an incentive for men to be more considerate towards their wives and treat them with respect so that they do not feel compelled to seek out other partners. In short, this hadith teaches us that we should always strive for fairness and justice when it comes to matters related to marriage and divorce in Islam.
