Ownership of Wala'

SUMMARY: The Prophet (s.a.w) taught that the Wala' belongs to the one who pays for it or grants the favor.

Aishah narrated that she wanted to buy Barirah but (her owners) stipulated that they should have her Wala', so the Prophet (s.a.w) said: "The Wala' is for the one who gives the price, or for the one who grants the favor". Abu 'Eisa said: There are narrations on this topic from Ibn 'Umar and Abu Hurairah. This Hadith is Hasan Sahih, and this is acted upon according to the people of knowledge.
حَدَّثَنَا بُنْدَارٌ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، حَدَّثَنَا سُفْيَانُ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنِ الأَسْوَدِ، عَنْ عَائِشَةَ، أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ، بَرِيرَةَ فَاشْتَرَطُوا الْوَلاَءَ فَقَالَ النَّبِيُّ ‏ "‏ الْوَلاَءُ لِمَنْ أَعْطَى الثَّمَنَ أَوْ لِمَنْ وَلِيَ النِّعْمَةَ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنِ ابْنِ عُمَرَ وَأَبِي هُرَيْرَةَ ‏.‏ وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ

EXPLANATIONS:
This hadith is about ownership of Wala'. The Prophet (s.a.w) taught that when someone wants to buy something from another person, they should agree on who will have the right to the Wala'. The Wala' is a form of protection and loyalty given by a master to their slave or servant and it belongs either to the one who pays for it or grants them a favor. This hadith has been narrated by Aishah, Ibn 'Umar and Abu Hurairah and is considered Hasan Sahih according to people of knowledge. It teaches us that we should be fair in our dealings with others and respect agreements made between two parties when buying something from each other.
