Dispute Resolution Through Oath

SUMMARY: The hadith is about a dispute between two men, one from Hadhramaut and the other from Kindah, over a piece of land. The Prophet (PBUH) suggested that the man from Hadhramaut should take an oath to prove his claim.

'Alqamah b. Wa’il b. Hujr al-Hadrami said on the authority of the father: A man from Hadhramaut and a man from Kindah came to the Messenger of Allah . The hadrami said: Messenger of Allah, this (man) has seized land which belonged to my father. Al-Kindi said: That is my land in my possession and I cultivate it; he has no right to it. The Holy prophet (may be peace upon him) said to the Hadrami: Have you any proof? We said : #he (the Prophet)said: Then he will swear an oath for you . He said: Messenger of Allah, he is a reprobate and he would not care to swear to anything and stick at nothing. He said: That is only your recourse

QUICK LESSONS:
Provide evidence to support your claims and accept others' rights with respect .

EXPLANATIONS:
This hadith discusses how disputes can be resolved through taking an oath. It tells us that when two people are in disagreement over something, they should provide evidence to support their claims. If there is no evidence available, then one of them can take an oath to prove their claim. This hadith also teaches us that we should not rely on someone's word if they have a reputation for dishonesty or untrustworthiness as it may not be reliable. Taking an oath is only acceptable if both parties agree and trust each other enough to accept it as proof of truthfulness.
