Dispute Over Relationship of Son of Slave Girl

SUMMARY: The hadith is about a dispute between two men over the relationship of a son of a slave girl. The Prophet (PBUH) ruled that the child should be attributed to the one on whose bed it was born and that the fornicator has no right.

A’ishah said "Sa’d bin Abi Waqqas and 'Abd bin Zamah disputed amongst themselves about the (relationship of the) son of the slave girl of Zam’ah and brought the case to the Apostle of Allaah. Sa’d said "My brother 'Utbah enjoined me that when I came to Makkah I should see the son of the slave girl of Zam’ah and take his possession for that is his son"'.Abd bin Zam’ah said "He is my brother, the son of my father’s slave girl having been born on my father’s bed". The Apostle of Allaah saw his clear resemblance to 'Utbah. So he said "The child is attributed to the one on whose bed it is born and the fornicator is deprived of any right (lit. the fornicator will have the stone). Veil yourself from him, Saudah. Musaddad added in his version "he is your brother 'Abd".
حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ، وَمُسَدَّدٌ، قَالاَ حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، اخْتَصَمَ سَعْدُ بْنُ أَبِي وَقَّاصٍ وَعَبْدُ بْنُ زَمْعَةَ إِلَى رَسُولِ اللَّهِ فِي ابْنِ أَمَةِ زَمْعَةَ فَقَالَ سَعْدٌ أَوْصَانِي أَخِي عُتْبَةُ إِذَا قَدِمْتُ مَكَّةَ أَنْ أَنْظُرَ إِلَى ابْنِ أَمَةِ زَمْعَةَ فَأَقْبِضَهُ فَإِنَّهُ ابْنُهُ ‏.‏ وَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي ابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِ أَبِي ‏.‏ فَرَأَى رَسُولُ اللَّهِ شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ ‏"‏ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَاحْتَجِبِي عَنْهُ يَا سَوْدَةُ ‏"‏ ‏.‏ زَادَ مُسَدَّدٌ فِي حَدِيثِهِ وَقَالَ ‏"‏ هُوَ أَخُوكَ يَا عَبْدُ

EXPLANATIONS:
This hadith is about a dispute between Sad bin Abi Waqqas and 'Abd bin Zamah over the relationship of a son born to Zamah's slave girl. Sad claimed that his brother, 'Utbah, had instructed him to take possession of this child when he arrived in Makkah as it was his son. However, Abd bin Zamah argued that he was his brother as he was born on his father's bed. The Prophet Muhammad ﷺ then ruled in favor of Abd bin Zamah by saying "The child is attributed to the one on whose bed it is born and the fornicator is deprived of any right". He also advised Sauda, who was present at this incident, to veil herself from him as he was her brother. Musaddad added in his version "he is your brother 'Abd". This hadith teaches us an important lesson about justice and fairness; even if someone has committed an immoral act such as adultery or fornication they are still not deprived from their rights according to Islamic law. It also teaches us how important family ties are in Islam; even if someone has been conceived out wedlock they still have rights within their family unit which must be respected by all parties involved.
