Stealing Produce and Palm Trees

SUMMARY: The Prophet Muhammad (PBUH) taught that the hand should not be cut off for stealing produce or the spadix of palm trees.

It was narrated that Rafi bin Khadij said: "I heard the Messenger of Allah say: 'The hand is not to be cut off for (stealing) produce or the spadix of palm trees"'.
أَخْبَرَنَا عَبْدُ الْحَمِيدِ بْنُ مُحَمَّدٍ، قَالَ حَدَّثَنَا مَخْلَدٌ، قَالَ حَدَّثَنَا سُفْيَانُ، عَنِ يَحْيَى، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، عَنِ النَّبِيِّ قَالَ ‏ "‏ لاَ قَطْعَ فِي ثَمَرٍ وَلاَ كَثَرٍ

EXPLANATIONS:
This hadith teaches us that stealing is wrong and should not be done. However, it also teaches us that there are certain limits to punishment for theft. In this case, the Prophet Muhammad (PBUH) said that a person's hand should not be cut off if they steal produce or the spadix of palm trees. This shows us how merciful and compassionate he was in his teachings. He wanted to ensure justice was served but also wanted to make sure people were treated fairly and with mercy when possible.
