Prophet Muhammad's Ruling on Killing and Diyah

SUMMARY: The hadith is about the ruling of Prophet Muhammad (PBUH) concerning a woman who killed another woman and her fetus.

'Amr bin Dinar narrated that: he heard Tawus narrate from Ibn 'Abbas, from 'Umar, may Allah be pleased with him, that he asked about the ruling of the Messenger of Allah concerning that. Hamal bin Malik stood up and said: "I was married to two women, and one of them struck the other with a tent pole and killed her and her fetus. The Prophet ruled that a slave be given (as Diyah) for her fetus and that she be killed (for killing the other woman)".
أَخْبَرَنَا يُوسُفُ بْنُ سَعِيدٍ، قَالَ حَدَّثَنَا حَجَّاجُ بْنُ مُحَمَّدٍ، عَنِ ابْنِ جُرَيْجٍ، قَالَ أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ، أَنَّهُ سَمِعَ طَاوُسًا، يُحَدِّثُ عَنِ ابْنِ عَبَّاسٍ، عَنْ عُمَرَ، رضى الله عنه أَنَّهُ نَشَدَ قَضَاءَ رَسُولِ اللَّهِ فِي ذَلِكَ فَقَامَ حَمَلُ بْنُ مَالِكٍ فَقَالَ كُنْتُ بَيْنَ حُجْرَتَىِ امْرَأَتَيْنِ فَضَرَبَتْ إِحْدَاهُمَا الأُخْرَى بِمِسْطَحٍ فَقَتَلَتْهَا وَجَنِينَهَا فَقَضَى النَّبِيُّ فِي جَنِينِهَا بِغُرَّةٍ وَأَنْ تُقْتَلَ بِهَا

EXPLANATIONS:
This hadith narrates the ruling of the Messenger of Allah concerning a woman who killed another woman and her fetus. Hamal bin Malik stood up to explain that he was married to two women, one of whom struck the other with a tent pole and killed her as well as her unborn child. The Prophet ruled that a slave should be given as diyah for the fetus and that she should be killed for killing the other woman. This hadith teaches us about justice in Islam; it shows us how even an unborn child has rights which must be respected by giving diyah if it is wrongfully taken away from its parents. It also teaches us about accountability; no matter what our status or position in society may be, we are all accountable for our actions before Allah Almighty.
