Women's Right to Decide Marriage

SUMMARY: A previously married woman has more right to decide about her marriage than her guardian, and an orphan girl should be consulted and her permission is assumed if she remains silent.

It was narrated from Ibn 'Abbas that the Prophet said: "A previously married woman has more right to decide about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted, and her permission is her silence".
أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلاَنَ، قَالَ حَدَّثَنَا أَبُو دَاوُدَ، قَالَ حَدَّثَنَا شُعْبَةُ، عَنْ مَالِكِ بْنِ أَنَسٍ، قَالَ سَمِعْتُهُ مِنْهُ، بَعْدَ مَوْتِ نَافِعٍ بِسَنَةٍ وَلَهُ يَوْمَئِذٍ حَلْقَةٌ قَالَ أَخْبَرَنِي عَبْدُ اللَّهِ بْنُ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ قَالَ ‏ "‏ الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ وَإِذْنُهَا صُمَاتُهَا

This hadith speaks of the rights of women in regards to marriage. It states that a previously married woman has more right to decide about herself with regard to marriage than her guardian. Similarly, it also states that an orphan girl should be consulted and if she remains silent, then it is assumed that she has given permission. This hadith emphasizes the importance of giving women their due rights in deciding their own marriages as well as respecting the wishes of orphans when it comes to such matters. It teaches us that we must respect the autonomy of women and orphans when it comes to decisions regarding their lives, especially those related to marriage.
