Sahih Muslim 1351a (Book 15, Hadith 498) #10433
Inheritance of Abu Talib's Property

SUMMARY: This hadith is about the inheritance of Abu Talib's property and how it was divided among his sons.

Usama b. Zaid b. Haritha (Allah be pleased with him) said to Allah's Messenger : Will you stay in your house at Mecca (which you abandoned at the time of migration)? Thereupon he said: Has 'Aqil left for as any land or house? And 'Aqil and Talib became the Inheritors of Abu Talib's (property), and neither Ja'far nor 'Ali inherited anything from him, for both (Ja'far and 'Ali) were Muslims whereas 'Aqil and Talib were non-Muslims.

QUICK LESSONS:
Follow Islamic laws regarding inheritance fairly and justly without bias towards any particular person based on their religious beliefs or lack thereof .

EXPLANATIONS:
This hadith is about the inheritance of Abu Talib's property and how it was divided among his sons. Usama b. Zaid b. Haritha asked Allah's Messenger if he would stay in his house at Mecca, which he abandoned at the time of migration, to which Allah's Messenger replied by asking if 'Aqil left for any land or house? It turns out that 'Aqil and Talib became the inheritors of Abu Talib’s property while Ja'far and 'Ali did not inherit anything from him because they were Muslims whereas 'Aqil and Talib were non-Muslims according to Islamic law known as faraidh or wasiyyah. This hadith teaches us that when it comes to inheritance, Islamic law must be followed even if it means that some family members do not receive a share in the inheritance due to their religious beliefs or lack thereof.
