Payment of Diya for Killing

SUMMARY: The Prophet ﷺ judged that the Diya for a woman killed by another woman was to be paid by the 'Asaba of the killer, and the Diya for a fetus killed in her womb was a male or female slave.

Narrated Abu Huraira: Two women from Hudhail fought with each other and one of them hit the other with a stone that killed her and what was in her womb. The relatives of the killer and the relatives of the victim submitted their case to the Prophet who judged that the Diya for the fetus was a male or female slave, and the Diya for the killed woman was to be paid by the 'Asaba (near relatives) of the killer.
حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ، حَدَّثَنَا ابْنُ وَهْبٍ، حَدَّثَنَا يُونُسُ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيَّبِ، وَأَبِي، سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ أَنَّ أَبَا هُرَيْرَةَ ـ رضى الله عنه ـ قَالَ اقْتَتَلَتِ امْرَأَتَانِ مِنْ هُذَيْلٍ، فَرَمَتْ إِحْدَاهُمَا الأُخْرَى بِحَجَرٍ قَتَلَتْهَا وَمَا فِي بَطْنِهَا، فَاخْتَصَمُوا إِلَى النَّبِيِّ فَقَضَى أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ، وَقَضَى دِيَةَ الْمَرْأَةِ عَلَى عَاقِلَتِهَا‏.‏

EXPLANATIONS:
This hadith is about how to handle cases where one person kills another person or their unborn child. The Prophet Muhammad ﷺ ruled that if someone kills an unborn child, they must pay diyah, which is money given as compensation to the victim's family. If someone kills an adult, then their relatives must pay diyah to the victim's family. This ruling shows us that Islam values justice and fairness and encourages people to take responsibility for their actions. It also teaches us that we should not take matters into our own hands but instead seek justice through legal means such as trials and courts of law.
