Verdict for Abortion Caused by Somebody Else

SUMMARY: The Prophet ﷺ gave a verdict that a male or female slave should be given as Diya in the case of a woman's abortion caused by somebody else.

Narrated Hisham's father from Al-Mughira bin Shu'ba: 'Umar consulted the companions about the case of a woman's abortion (caused by somebody else). Al-Mughira said: The Prophet gave the verdict that a male or female slave should be given (as a Diya). Then Muhammad bin Maslama testified that he had witnessed the Prophet giving such a verdict.
حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا وُهَيْبٌ، حَدَّثَنَا هِشَامٌ، عَنْ أَبِيهِ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، عَنْ عُمَرَ ـ رضى الله عنه ـ أَنَّهُ اسْتَشَارَهُمْ فِي إِمْلاَصِ الْمَرْأَةِ فَقَالَ الْمُغِيرَةُ قَضَى النَّبِيُّ بِالْغُرَّةِ عَبْدٍ أَوْ أَمَةٍ‏.‏ فَقَالَ ائْتِ مَنْ يَشْهَدُ مَعَكَ، فَشَهِدَ مُحَمَّدُ بْنُ مَسْلَمَةَ أَنَّهُ شَهِدَ النَّبِيَّ قَضَى بِهِ‏.‏

EXPLANATIONS:
In this hadith, Umar consulted the companions about the case of a woman's abortion caused by somebody else. Al-Mughira said that the Prophet (ﷺ) gave the verdict that a male or female slave should be given as Diya. This was then confirmed by Muhammad bin Maslama who testified that he had witnessed the Prophet giving such a verdict. This hadith teaches us to seek justice and fairness in all matters, even if it is not our own wrongdoing. It also teaches us to respect and follow what has been taught to us through religious teachings and traditions, even if it may not seem fair at first glance. We must remember that Allah knows best and He will always provide justice for those who seek it out with sincerity and faithfulness.
