The Legally Prescribed Period for Divorce

SUMMARY: This hadith explains the legal period for divorce prescribed by Allah, which is when a woman is clean and before having any sexual relations with her.

Narrated Salim: That 'Abdullah bin 'Umar told him that he had divorced his wife while she was in her menses so 'Umar informed Allah's Messenger of that. Allah's Messenger became very angry at that and said, "(Ibn 'Umar must return her to his house and keep her as his wife till she becomes clean and then menstruates and becomes clean again, whereupon, if he wishes to divorce her, he may do so while she is still clean and before having any sexual relations with her, for that is the legally prescribed period for divorce as Allah has ordered".
حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ، حَدَّثَنَا اللَّيْثُ، قَالَ حَدَّثَنِي عُقَيْلٌ، عَنِ ابْنِ شِهَابٍ، قَالَ أَخْبَرَنِي سَالِمٌ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ ـ رضى الله عنهما ـ أَخْبَرَهُ أَنَّهُ، طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ، فَذَكَرَ عُمَرُ لِرَسُولِ اللَّهِ فَتَغَيَّظَ فِيهِ رَسُولُ اللَّهِ ثُمَّ قَالَ ‏ "‏ لِيُرَاجِعْهَا ثُمَّ يُمْسِكْهَا حَتَّى تَطْهُرَ، ثُمَّ تَحِيضَ فَتَطْهُرَ، فَإِنْ بَدَا لَهُ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا طَاهِرًا قَبْلَ أَنْ يَمَسَّهَا فَتِلْكَ الْعِدَّةُ كَمَا أَمَرَهُ اللَّهُ

EXPLANATIONS:
This hadith explains the legally prescribed period for divorce as ordained by Allah. According to this hadith, if a man divorces his wife while she is in her menses then he must return her to his house and keep her as his wife until she becomes clean again. After that, if he wishes to divorce her then he may do so while she is still clean and before having any sexual relations with her. This shows that it is important to follow the laws of Allah when it comes to marriage and divorce in order to ensure justice between both parties involved. It also teaches us that we should be patient during difficult times such as when going through a separation or divorce because there are certain limits set by Allah which must be followed in order for things to go smoothly.
