Inheritance of Believers and Non-Believers

SUMMARY: Believers and non-believers cannot inherit each other's property.

Narrated 'Amr bin 'Uthman: Usama bin Zaid said during the Conquest (of Mecca), "O Allah's Messenger ! Where will we encamp tomorrow?" The Prophet said, "But has 'Aqil left for us any house to lodge in?" He then added, "No believer will inherit an infidel's property, and no infidel will inherit the property of a believer". Az- Zuhri was asked, "Who inherited Abu Talib?" Az-Zuhri replied, "Ail and Talib inherited him".
حَدَّثَنَا سُلَيْمَانُ بْنُ عَبْدِ الرَّحْمَنِ، حَدَّثَنَا سَعْدَانُ بْنُ يَحْيَى، حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي حَفْصَةَ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، أَنَّهُ قَالَ زَمَنَ الْفَتْحِ يَا رَسُولَ اللَّهِ، أَيْنَ تَنْزِلُ غَدًا قَالَ النَّبِيُّ ‏"‏ وَهَلْ تَرَكَ لَنَا عَقِيلٌ مِنْ مَنْزِلٍ ‏"‏‏.‏ ثُمَّ قَالَ ‏"‏ لاَ يَرِثُ الْمُؤْمِنُ الْكَافِرَ، وَلاَ يَرِثُ الْكَافِرُ الْمُؤْمِنَ ‏"‏‏.‏ قِيلَ لِلزُّهْرِيِّ وَمَنْ وَرِثَ أَبَا طَالِبٍ قَالَ وَرِثَهُ عَقِيلٌ وَطَالِبٌ‏.‏ قَالَ مَعْمَرٌ عَنِ الزُّهْرِيِّ أَيْنَ تَنْزِلُ غَدًا‏.‏ فِي حَجَّتِهِ، وَلَمْ يَقُلْ يُونُسُ حَجَّتِهِ وَلاَ زَمَنَ الْفَتْحِ‏.‏

EXPLANATIONS:
This hadith is about the inheritance of believers and non-believers. It was narrated by 'Amr bin 'Uthman that Usama bin Zaid asked the Prophet Muhammad ﷺ where they would camp the next day during the Conquest of Mecca. The Prophet ﷺ then asked if Aqil had left them any house to stay in, before adding that no believer will inherit an infidel's property, nor will an infidel inherit a believer's property. When asked who inherited Abu Talib, Az-Zuhri replied that Ail and Talib inherited him. This hadith teaches us that believers and non-believers cannot inherit each other’s properties as it is not permissible according to Islamic law.
