Punishment for Slave-Girl's Fornication

SUMMARY: The hadith discusses the punishment for a slave-girl who commits fornication and is not muhsana.

Malik related to me from Ibn Shihab from Ubaydullah ibn Abdullah ibn Utba ibn Masud from Abu Hurayra and Zayd ibn Khalid al-Juhani that the Messenger of Allah, may Allah bless him and grant him peace, was asked about a slave-girl who committed fornication and was not muhsana. He said, "If she commits fornication, then flog her. If she commits fornication again, then flog her, and if she commits fornication again, then sell her, if only for a rope". Ibn Shihab added, "I don't know whether it was three or four times".
حَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، أَنَّ رَسُولَ اللَّهِ سُئِلَ عَنِ الأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصِنْ فَقَالَ ‏ "‏ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ ‏"‏ ‏.‏ قَالَ ابْنُ شِهَابٍ لاَ أَدْرِي أَبَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ

EXPLANATIONS:
This hadith discusses the punishment that should be given to a slave girl who commits fornication and is not muhsana. According to the Prophet Muhammad ﷺ if she commits this sin once then she should be flogged as a punishment. If she repeats it again then she should be flogged again and if it happens one more time then she should be sold even if it is only for a rope. This hadith teaches us that we must take action against those who commit sins in order to protect society from immorality and corruption. It also shows us that we must treat people with justice even when they are slaves or have committed wrongdoings as Allah ﷻ has commanded us to do so in His book.
