Bride-Price for Slave-Girl Who Was Set Free

SUMMARY: A slave-girl who was married to a slave and was set free before consummating the marriage had no bride-price and it was considered a pronouncement of divorce.

Malik said that if a slave-girl, who was the wife of a slave, was set free before he had consummated the marriage, and she chose herself, then she had no bride-price and it was a pronouncement of divorce. That was what was done among them.

According to the hadith narrated by Malik, if a slave girl who is married to a slave is set free before they have consummated their marriage, then she has no bride price and it is considered as an announcement of divorce. This shows that even in cases where couples are unable to complete their marriage due to circumstances beyond their control, they can still be legally separated without any financial burden on either party. This also serves as an example of how Islamic law takes into account the rights of both parties in any situation.
