Inheritance Rights of Women

SUMMARY: A woman may receive inheritance from three sources: a freed slave woman, a foundling she raised, and her child whom she swore was legitimate.

It was narrated from Wathilah bin Asqa’ that the Prophet said: "A woman may get three types of inheritance: From her freed slave woman, a foundling whom she raised, and her child concerning whom she swore in Li’an that he was legitimate".
حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، حَدَّثَنَا مُحَمَّدُ بْنُ حَرْبٍ، حَدَّثَنَا عُمَرُ بْنُ رُؤْبَةَ التَّغْلِبِيُّ، عَنْ عَبْدِ الْوَاحِدِ بْنِ عَبْدِ اللَّهِ النَّصْرِيِّ، عَنْ وَاثِلَةَ بْنِ الأَسْقَعِ، عَنِ النَّبِيِّ قَالَ ‏ "‏ الْمَرْأَةُ تَحُوزُ ثَلاَثَ مَوَارِيثَ عَتِيقِهَا وَلَقِيطِهَا وَوَلَدِهَا الَّذِي لاَعَنَتْ عَلَيْهِ ‏"‏ ‏.‏ قَالَ مُحَمَّدُ بْنُ يَزِيدَ مَا رَوَى هَذَا الْحَدِيثَ غَيْرُ هِشَامٍ

EXPLANATIONS:
This hadith explains the rights of women to receive inheritance from three different sources. The first source is a freed slave woman, meaning that if a woman frees her female slave then the former slave is entitled to an inheritance from her former owner. The second source is a foundling whom the woman has raised; this means that if a woman takes in and raises an orphaned child then they are entitled to an inheritance from their adoptive mother. Lastly, the third source is her own child concerning whom she swore in Lian that he was legitimate; this means that if there are any doubts about whether or not one's own child is legitimate then they can swear in Lian and their child will be eligible for an inheritance. This hadith emphasizes the importance of protecting women's rights when it comes to receiving inheritances.
