Punishment for Intercourse with Slave Woman

SUMMARY: The hadith is about a man who was brought to Nu'man bin Bashir for judgement after having intercourse with his wife's slave woman. Nu'man bin Bashir decided that if the wife had made her lawful for him, he would be given one hundred lashes, but if she had not given permission, he would be stoned.

It was narrated that Habib bin Salim said: "A man who had intercourse with the slave woman of his wife was brought to Nu'man bin Bashir. He said: 'I will pass no other judgement than that of the Messenger of Allah He said: 'If (his wife) had made her lawful for him, then I will give him one hundred lashes, but if she has not given permission, I will stone him'. "
حَدَّثَنَا حُمَيْدُ بْنُ مَسْعَدَةَ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، أَنْبَأَنَا سَعِيدٌ، عَنْ قَتَادَةَ، عَنْ حَبِيبِ بْنِ سَالِمٍ، قَالَ أُتِيَ النُّعْمَانُ بْنُ بَشِيرٍ بِرَجُلٍ غَشَى جَارِيَةَ امْرَأَتِهِ فَقَالَ لاَ أَقْضِي فِيهَا إِلاَّ بِقَضَاءِ رَسُولِ اللَّهِ ‏.‏ قَالَ إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ مِائَةً وَإِنْ لَمْ تَكُنْ أَذِنَتْ لَهُ رَجَمْتُهُ

EXPLANATIONS:
This hadith discusses the punishment that should be given to a man who has intercourse with his wife's slave woman without her permission. According to the Prophet Muhammad, if the wife has made her lawful for him then he should receive one hundred lashes as punishment. However, if she has not given permission then he should be stoned. This shows that it is important to respect other people's property and not take advantage of them without their consent or approval. It also teaches us that we must always seek justice and fairness in all matters and never take advantage of someone else's misfortune or vulnerability.

The Prophet Muhammad also taught us that we must always strive to do what is right and just even when it may seem difficult or unpopular at first glance. He showed us how important it is to stand up for what we believe in even when others may disagree with us or try to pressure us into doing something else instead. We must remember this lesson whenever we are faced with difficult decisions in life so that we can make sure our actions are guided by justice and fairness rather than selfishness or greediness.
