The Importance of Taking an Oath

SUMMARY: This hadith explains the importance of taking an oath in order to prove one's right to a certain possession.

Narrated Ibn 'Abbas: "A man from Banu Sahm went out with Tamim Ad-Dari and 'Adi bin Badda. The Sahmi man died in a land in which there were no Muslims. When they arrived with what he left behind, they searched for a bowl made of silver which was inlaid with gold. The Messenger of Allah had the two of them take an oath. Then they found the bowl in Makkah, and the person said: 'We purchased it from Tamim and 'Adi'. So two men among the relatives of the Sahmi man stood to take an oath by Allah that they (his family) had more right to it than them". He said: "So it was about them that the following was revealed: O you who believe! (When death approaches any of you then) take the testimony (5:106)".
حَدَّثَنَا سُفْيَانُ بْنُ وَكِيعٍ، حَدَّثَنَا يَحْيَى بْنُ آدَمَ، عَنِ ابْنِ أَبِي زَائِدَةَ، عَنْ مُحَمَّدِ بْنِ أَبِي الْقَاسِمِ، عَنْ عَبْدِ الْمَلِكِ بْنِ سَعِيدٍ، عَنْ أَبِيهِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ خَرَجَ رَجُلٌ مِنْ بَنِي سَهْمٍ مَعَ تَمِيمٍ الدَّارِيِّ وَعَدِيِّ بْنِ بَدَاءٍ فَمَاتَ السَّهْمِيُّ بِأَرْضٍ لَيْسَ فِيهَا مُسْلِمٌ فَلَمَّا قَدِمَا بِتَرِكَتِهِ فَقَدُوا جَامًا مِنْ فِضَّةٍ مُخَوَّصًا بِالذَّهَبِ فَأَحْلَفَهُمَا رَسُولُ اللَّهِ ثُمَّ وُجِدَ الْجَامُ بِمَكَّةَ فَقِيلَ اشْتَرَيْنَاهُ مِنْ عَدِيٍّ وَتَمِيمٍ فَقَامَ رَجُلاَنِ مِنْ أَوْلِيَاءِ السَّهْمِيِّ فَحَلَفَا بِاللَّهِ لَشَهَادَتُنَا أَحَقُّ مِنْ شَهَادَتِهِمَا وَأَنَّ الْجَامَ لِصَاحِبِهِمْ ‏.‏ قَالَ وَفِيهِمْ نَزَلَتْ ‏:‏ ‏(‏ يَا أَيُّهَا الَّذِينَ آمَنُوا شَهَادَةُ بَيْنِكُمْ ‏)‏ هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ وَهُوَ حَدِيثُ ابْنِ أَبِي زَائِدَةَ

EXPLANATIONS:
This hadith highlights the importance of taking an oath when it comes to proving one's right over a certain possession. In this particular case, two men from Banu Sahm went out with Tamim Ad-Dari and 'Adi bin Badda, and the Sahmi man died in a land where there were no Muslims. When they returned with what he left behind, they searched for a bowl made of silver which was inlaid with gold. The Messenger of Allah then asked them to take an oath that they were not responsible for its disappearance. Later on, it was found that two men among the relatives of the Sahmi man had more right to it than them and thus this incident led to revelation of verse 5:106 from Quran which states “O you who believe! When death approaches any of you then take the testimony”. This Hadith teaches us that we should always be honest and truthful when giving our testimony or taking an oath as it is very important for justice and fairness in society. It also teaches us about being patient during difficult times as Allah will eventually bring justice if we are truthful about our claims or rights over something.
