Permissibility of Marrying Women Who Were Already Married

SUMMARY: Allah revealed a verse in the Quran to clarify that it is permissible to marry women who were already married to idolaters.

Narrated Abu Sa'eed Al-Khudri: "On the Day of Awtas, we captured some women who had husbands among the idolaters. So some of the men disliked that, so Allah, Most High, revealed: And women already married, except those whom your right hands possess. (4:24)"
حَدَّثَنَا عَبْدُ بْنُ حُمَيْدٍ، أَخْبَرَنَا حَبَّانُ بْنُ هِلاَلٍ، حَدَّثَنَا هَمَّامُ بْنُ يَحْيَى، حَدَّثَنَا قَتَادَةُ، عَنْ أَبِي الْخَلِيلِ، عَنْ أَبِي عَلْقَمَةَ الْهَاشِمِيِّ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، قَالَ لَمَّا كَانَ يَوْمُ أَوْطَاسٍ أَصَبْنَا نِسَاءً لَهُنَّ أَزْوَاجٌ فِي الْمُشْرِكِينَ فَكَرِهَهُنَّ رِجَالٌ مِنْهُمْ فَأَنْزَلَ اللَّهُ ‏:‏ ‏(‏وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلاَّ مَا مَلَكَتْ أَيْمَانُكُمْ ‏)‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ

EXPLANATIONS:
This hadith narrates an incident where some men captured women who were already married to idolaters. Some of the men disliked this, so Allah revealed a verse in the Quran which clarified that it is permissible for them to marry these women. The verse states, “And women already married, except those whom your right hands possess”(4:24). This means that if someone has taken possession of a woman through war or any other means, then they are allowed to marry her without having her divorce her previous husband first. This hadith teaches us about marriage laws and regulations as well as how Allah reveals verses in the Quran when needed.
