Eating from Orchards

SUMMARY: It is permissible to eat from the fruits of an orchard, but it is not allowed to take any in one's garment.

Narrated Ibn 'Umar: That the Prophet said: "Whoever enters an orchard then let him eat, but not take any in his garment". He said: There are narrations on this topic from 'Abdullah bin 'Amr, 'Abbad bin Shurahbil, Rafi' bin 'Amr, 'Umair the freed slave of Abi Al-Lahm, and Abu Hurairah. Abu 'Eisa said: The Hadith of Ibn 'Umar is Gharib Hadith. We do not know of it from this route except from Yahya bin Sulaim. Some of the people of knowledge have permitted the wayfarer to eat from the fruits, and some of them disliked it without paying.
حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ أَبِي الشَّوَارِبِ، حَدَّثَنَا يَحْيَى بْنُ سُلَيْمٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنِ النَّبِيِّ قَالَ ‏ "‏ مَنْ دَخَلَ حَائِطًا فَلْيَأْكُلْ وَلاَ يَتَّخِذْ خُبْنَةً ‏"‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو وَعَبَّادِ بْنِ شُرَحْبِيلَ وَرَافِعِ بْنِ عَمْرٍو وَعُمَيْرٍ مَوْلَى آبِي اللَّحْمِ وَأَبِي هُرَيْرَةَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ غَرِيبٌ لاَ نَعْرِفُهُ مِنْ هَذَا الْوَجْهِ إِلاَّ مِنْ حَدِيثِ يَحْيَى بْنِ سُلَيْمٍ ‏.‏ وَقَدْ رَخَّصَ فِيهِ بَعْضُ أَهْلِ الْعِلْمِ لاِبْنِ السَّبِيلِ فِي أَكْلِ الثِّمَارِ وَكَرِهَهُ بَعْضُهُمْ إِلاَّ بِالثَّمَنِ

This hadith discusses the permissibility of eating from an orchard without taking any in one's garment. The Prophet Muhammad ﷺ said that whoever enters an orchard should be allowed to eat from its fruits but not take any with them in their garments. There are several narrations on this topic by different people including Ibn Umar and Abdullah bin Amr. Some scholars have permitted travelers to eat from the fruits without paying while others have disliked it. This hadith teaches us that we should be mindful when entering someone else’s property and respect their rights by not taking anything away with us without permission. We should also remember that if we are given something for free then we must thank Allah for His blessings and show gratitude towards those who gave us something out of kindness.
