Separation of Couples and Child Custody

SUMMARY: The Prophet separated a couple who had pronounced Li'an on each other and decided that the child belonged to the mother.

Ibn Umar narrated: "A man pronounced the Li'an on his wife, and the Prophet separated the two of them, and he decide that the child belonged to the mother".
أَنْبَأَنَا قُتَيْبَةُ، أَنْبَأَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ لاَعَنَ رَجُلٌ امْرَأَتَهُ وَفَرَّقَ النَّبِيُّ بَيْنَهُمَا وَأَلْحَقَ الْوَلَدَ بِالأُمِّ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ

EXPLANATIONS:
This hadith is about a man and woman who were married but then pronounced Li’an on each other. Li’an is an Arabic term which means to curse one another in front of two witnesses. In this case, the Prophet Muhammad separated them and decided that the child should stay with its mother. This hadith teaches us that even when couples are facing difficult times in their marriage, they should not resort to cursing each other as it will only lead to separation. It also teaches us that children should be taken care of by their mothers if there is a divorce or separation between parents.
