Liability of Injuries Caused by Animals, Mines & Wells

SUMMARY: The Prophet Muhammad (PBUH) taught that no one is liable for injuries caused by animals, mines, and wells, and Khumus is due on Rikaz.

Abu Hurairah narrated that : the Messenger of Allah said: "The injuries caused by the animal are without liability, and mines are without liability, and wells are without liability, and the Khumus is due on Rikaz".
حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، وَأَبِي، سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ، عَنْ رَسُولِ اللَّهِ قَالَ ‏ "‏ الْعَجْمَاءُ جُرْحُهَا جُبَارٌ وَالْمَعْدِنُ جُبَارٌ وَالْبِئْرُ جُبَارٌ وَفِي الرِّكَازِ الْخُمْسُ ‏"‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ أَنَسِ بْنِ مَالِكٍ وَعَبْدِ اللَّهِ بْنِ عَمْرٍو وَعُبَادَةَ بْنِ الصَّامِتِ وَعَمْرِو بْنِ عَوْفٍ الْمُزَنِيِّ وَجَابِرٍ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ

EXPLANATIONS:
This hadith was narrated by Abu Hurairah who reported that the Messenger of Allah said that no one is liable for injuries caused by animals, mines or wells. He also taught that Khumus is due on Rikaz. The term ‘Khumus’ refers to a fifth part of something which has been taken from a person as a tax or tribute. The term ‘Rikaz’ refers to hidden treasures found in the earth such as gold and silver coins or precious stones. This hadith teaches us about justice and fairness in dealing with people's possessions and property rights. It also teaches us about responsibility towards our environment; we should be careful when digging into the ground so as not to cause any harm to others or their property.
