Ownership of Pollinated Date-Palm Fruits

SUMMARY: The hadith explains that when someone sells pollinated date-palms, the fruits will belong to the seller unless the buyer specifies otherwise.

Narrated 'Abdullah bin 'Umar: Allah's Messenger said, "If someone sells pollinated date-palms, their fruits will be for the seller, unless the buyer stipulates the contrary".
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ـ رضى الله عنهما ـ أَنَّ رَسُولَ اللَّهِ قَالَ ‏ "‏ مَنْ بَاعَ نَخْلاً قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ
