Blood-Wit and Retaliation

SUMMARY: The Prophet ﷺ offered to pay the blood-wit of a man killed by the Khuza'ah tribe, and declared that if anyone is killed in the future, his people will have a choice to accept blood-wit or to kill him.

Narrated AbuShurayb al-Ka'bi: The Prophet said: Then you, Khuza'ah, have killed this man of Hudhayl, but I will pay his blood-wit. After these words of mine if a man of anyone is killed, his people will have a choice to accept blood-wit or to kill him.
حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، قَالَ حَدَّثَنِي سَعِيدُ بْنُ أَبِي سَعِيدٍ، قَالَ سَمِعْتُ أَبَا شُرَيْحٍ الْكَعْبِيَّ، يَقُولُ قَالَ رَسُولُ اللَّهِ ‏ "‏ أَلاَ إِنَّكُمْ يَا مَعْشَرَ خُزَاعَةَ قَتَلْتُمْ هَذَا الْقَتِيلَ مِنْ هُذَيْلٍ وَإِنِّي عَاقِلُهُ فَمَنْ قُتِلَ لَهُ بَعْدَ مَقَالَتِي هَذِهِ قَتِيلٌ فَأَهْلُهُ بَيْنَ خِيرَتَيْنِ أَنْ يَأْخُذُوا الْعَقْلَ أَوْ يَقْتُلُوا

EXPLANATIONS:
This hadith discusses two important concepts in Islamic law - diyya and qisas. Diyya is an amount of money paid by the perpetrator or their family as compensation for a crime committed against another person. Qisas is retaliation - when someone has been wronged, they can choose either to accept diyya or retaliate against the perpetrator. In this hadith, we see that Prophet Muhammad offered to pay diyya on behalf of a man who was killed by members of the Khuza'ah tribe. He then declared that if anyone else was killed in future, their people would have a choice between accepting diyya or retaliating against those responsible for their death. This hadith teaches us about justice and fairness - it shows us that we should not take matters into our own hands but instead seek justice through legal means such as accepting diyya or seeking retribution through qisas. It also teaches us about mercy - even though Prophet Muhammad could have chosen to retaliate against those responsible for killing his companion, he chose instead to offer them mercy by paying out diyya on his behalf.
