Sahih al-Bukhari 2214 (Book 34, Hadith 160) #2123
Pre-emption in Joint Undivided Property

SUMMARY: Pre-emption is valid in joint undivided property, but not when the boundaries are well marked or the ways and streets are fixed.

Narrated Jabir bin 'Abdullah: Allah's Messenger decided the validity of pre-emption in every joint undivided property, but if the boundaries were well marked or the ways and streets were fixed, then there was no pre-emption.

QUICK LESSONS:
Respect other people's rights even if they do not have any legal protection over them yet .

EXPLANATIONS:
This hadith discusses pre-emption which is a right of priority to purchase a property before anyone else. It states that pre-emption is valid in joint undivided properties but not when the boundaries are well marked or the ways and streets are fixed. This means that if two people own an undivided piece of land together then one person has the right to buy it before anyone else does. However if there are clear boundaries between them or if there are roads or pathways already established then this right of priority does not apply anymore. This hadith teaches us about fairness and justice as it ensures that no one can take advantage of another person's rights without their permission. It also encourages us to be mindful of our actions as we should always respect other people's rights even if they do not have any legal protection over them yet.
