Sunan an-Nasai 4895 (Book 46, Hadith 26) #19428
Equality in Punishment

SUMMARY: The hadith is about the importance of justice and equality in punishment, regardless of social class.

It was narrated from 'A'ishah that: A woman stole (something) and she was brought to the Prophet. They said: "Who would dare to speak to the Messenger of Allah except Usamah". So they spoke to Usamah and he spoke to (the Prophet). The Prophet said: "O Usamah, the Children of Israel were destroyed because whenever a noble person among them committed a crime, for which a Hadd punishment was deserved, they would let him go. But if a low-class person among them committed such a crime, they would carry out the punishment on him. If Fatimah bint Muhammad were to steal, I would cut off her hand".

QUICK LESSONS:
Treat everyone fairly under the law regardless of their background or status in society

EXPLANATIONS:
This hadith speaks to the importance of justice and equality when it comes to punishment. It was narrated by 'A'ishah that a woman was brought to the Prophet for stealing something, and people were hesitant to speak with him about it. Usamah spoke with him instead, and he said that if Fatimah bint Muhammad were to steal something, he would cut off her hand as a form of punishment. This shows that no matter who commits a crime, they should be punished equally according to Islamic law - even if they are from an important family or have high social standing. This hadith teaches us that everyone should be treated fairly under the law regardless of their background or status in society.
