Ruling of Diyah for Fetal Death

SUMMARY: The hadith is about the ruling of Diyah (blood money) for a fetus that was killed in the mother's womb.

It was narrated from Sa'eed bin Al-Musayyab that: the Messenger of Allah ruled that for a fetus which is killed in the mother's womb, a male or female slave be given (as Diyah). The one against whom he passed this ruling said: "How can I pay blood money for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked". The Messenger of Allah said: "This is one of the soothsayers"'.
قَالَ الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ، عَنِ ابْنِ الْقَاسِمِ، قَالَ حَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّ رَسُولَ اللَّهِ قَضَى فِي الْجَنِينِ يُقْتَلُ فِي بَطْنِ أُمِّهِ بِغُرَّةٍ عَبْدٍ أَوْ وَلِيدَةٍ فَقَالَ الَّذِي قَضَى عَلَيْهِ كَيْفَ أُغَرَّمُ مَنْ لاَ شَرِبَ وَلاَ أَكَلَ وَلاَ اسْتَهَلّ وَلاَ نَطَقَ فَمِثْلُ ذَلِكَ يُطَلّ فَقَالَ رَسُولُ اللَّهِ ‏ "‏ إِنَّمَا هَذَا مِنَ الْكُهَّانِ

EXPLANATIONS:
This hadith discusses the ruling of Diyah, or blood money, for a fetus that was killed in the mother's womb. The one against whom this ruling was passed questioned how he could pay blood money for someone who never ate, drank, shouted or cried at birth. To this, Prophet Muhammad responded by saying that this person is a soothsayer. This hadith teaches us to be mindful and respectful when it comes to rulings made by Prophet Muhammad and not question them as they are based on divine knowledge and wisdom. It also teaches us to be compassionate towards those who have suffered loss due to death or injury as we should strive to provide justice and compensation where possible.
