Selling Shared Property

SUMMARY: It is not permissible to sell a shared dwelling or garden without the permission of the partner.

Jabir b. 'Abdullah (Allah be pleased with them) reported Allah's Messenger as saying: He who has a partner in a dwelling or a garden, it is not lawful for him to sell that until he is permitted by his partner. If he (the partner) agrees, he should go in for that, and if he disapproves of that, he should abandon (the idea of selling it).
حَدَّثَنَا أَحْمَدُ بْنُ يُونُسَ، حَدَّثَنَا زُهَيْرٌ، حَدَّثَنَا أَبُو الزُّبَيْرِ، عَنْ جَابِرٍ، ح وَحَدَّثَنَا يَحْيَى بْنُ يَحْيَى، أَخْبَرَنَا أَبُو خَيْثَمَةَ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ قَالَ رَسُولُ اللَّهِ ‏ "‏ مَنْ كَانَ لَهُ شَرِيكٌ فِي رَبْعَةٍ أَوْ نَخْلٍ فَلَيْسَ لَهُ أَنْ يَبِيعَ حَتَّى يُؤْذِنَ شَرِيكَهُ فَإِنْ رَضِيَ أَخَذَ وَإِنْ كَرِهَ تَرَكَ

EXPLANATIONS:
This hadith teaches us that it is not permissible to sell a shared dwelling or garden without the permission of the partner. This means that if two people own a property together, they must both agree before it can be sold. The Prophet Muhammad ﷺ was teaching us about fairness and justice in this hadith, as well as respect for our partners and their rights. He wanted us to make sure that everyone involved in an agreement gets what they deserve and no one is taken advantage of. We should always strive to be fair and just when dealing with others, even if it means we have to give up something we want for ourselves.
